RULES AND REGULATIONS

The purpose of these Rules and Regulations is to promote the safe operation of the Poplar Tree Homeowners Association community swimming pool. The safety of pool patrons rests upon the reasonable conduct of each individual, proper parental supervision of children, and acknowledging the authority of the Pool Manager on duty to enforce these rules.

Nothing in these rules is intended to diminish parental responsibility for their children. Non-swimmers and novice swimmers require additional attention, for which neither the Association nor Pool Management assume responsibility.

The Pool Manager and assistants have been given complete operational authority at the pool. The Manager and assistants, by contract, are responsible to the Board of Directors, and should not be given direction by Association members. If you have a concern or complaint, please contact the Association's management company, Sequoia Management Company, listed below.

When the pool is to be closed for a special event, the times and dates of the closure will be posted prior to the closure. Such events may be limited. From time to time, the pool will be closed for repairs and appropriate inspection by County or State officials.

I. RIGHTS TO USE THE SWIMMING POOL
  • Every member, in good standing, of the Poplar Tree Homeowners Association has right to the full use of the community swimming pool.
  • Association members, by virtue of their use of the community swimming pool, agree to abide by these rules and regulations
  • The right of Association members to use the pool shall be suspended during any period in which any assessment against his/her lot remains unpaid [Article IV, Section 1(d), Deed of Dedication, August 2, 1978].
  • Any Association member violating these rules, or any other rules of the Association, including but not limited to, Architectural Control Guidelines, the Tennis Court Rules or Community Meeting Center Rules, may have his/her right to use the pool suspended for a period not to exceed sixty days [Section 1(d)] and [Resolution 95-1].
  • Pool privileges are not transferable. Privileges will be assigned to the owner of the property within the Association. He/she shall have the right to assign his/her privileges to the current resident if the owner does not reside in the Association property. Misuse of the pool privileges will be considered a violation of the rules.
  • A photo ID will be issued to those people ages 5 and over who reside on the property and have valid proof of residence.
II. ENFORCEMENT OF RULES
  • The Pool Manager and the Lifeguards are responsible for the safe and orderly operation of the pool. Any matter requiring immediate action shall be brought to the attention of the Pool Manager. The Pool Manager or his/her Assistant may eject anyone, at any time, from the pool enclosure for up to 24 hours. Such action shall be reported to the Chairperson of the Pool Committee for appropriate action.
  • Serious or repeated infractions of the regulations shall be reported to the Chairperson of the Pool Committee for appropriate action.
  • Any Association member, whose right to use of the pool has been suspended, may appeal that suspension to the Board of Directors at its next regularly scheduled meeting.
III. IDENTIFICATION
  • For identification and admission purposes, the photo identification card will be brought to the pool for the staff to verify membership before allowing a swimmer into the pool. The photo ID is to be picked up when you leave the pool for the day. A $5.00 replacement fee will be charged for lost photo Ids. It is recommended to update a child's photo ID every few years. This will be done at no charge to the member, upon surrender of the original ID.
  • Babysitter/Nanny, 14 years and older, may bring resident's children under age ten with a note of authorization from a parent and with approval of the Pool Manager. Notes are to be submitted to the Pool Manager. If the babysitter is a resident, his or her family must be current with their assessments. If the babysitter is a non-resident, he or she will have to pay the fee set by the Board of Directors. The fee for the season is $50. This fee allows only the babysitter/nanny access to the pool for the current season.
  • In order to obtain the photo ID, members need to contact Sequoia Management during regular business hours. All photo ID’s will be issued by Sequoia Management at their office or other designated location.

V. GUESTS
  • The daily guest fee per guest age five (5) and over is $3.00. Upon arrival at the pool, the association member must check in guests at the lifeguard station. All guest fees will be charged to the members account.
  • Association members shall accompany their guests to the pool, be responsible for their conduct, and for any damage incurred to community property by those guests. Failure to pay for such damage shall be grounds for suspension of the right to use of the swimming pool.
  • Guests must be accompanied by association members at all times. Guests must leave the pool facility when members leave.
VI. HEALTH AND SANITATION
  • All persons are required to wear proper swimming attire and take a shower prior to entering the pool.
  • Food and beverages, with the exception of water, may be consumed ONLY in designated areas. These areas consist of the fenced in grassy area, fenced in vending machine area, and the cabana area ONLY.
  • Glass containers are not permitted within the confines of the pool fence.
  • Persons with colds, coughs, diarrhea, inflamed eyes, nasal or ear discharge, infections, or wearing bandages are not permitted in the pool. Any persons with any type of contagious diseases are expected to use good judgment and refrain from entering the pool enclosure.
  • No pets are permitted in the pool area.
  • All trash shall be placed in the containers provided for this purpose.
  • Spitting, spouting of water and similar unhygienic actions are not permitted.
  • Smoking shall not be permitted on the premises.
VII. DIVING/SLIDE
  • Divers shall not step onto the diving board until the previous diver has cleared the board.
  • When a diver surfaces, he/she SHALL CLEAR OUT OF THE DIVING AREAS. No one may be in the diving area to catch a child jumping off the diving board.
  • Only one person is permitted on the board or ladder at any time.
  • Only one bounce on the board is allowed.
  • Running off the board shall not be allowed.
  • Children who are non-swimmers and/or who are novice swimmers should not use the diving board. If there is a question as to your child's ability, you should check with the pool manager.
  • Horseplay on the diving board is prohibited.
  • Use of the diving board or general swimming in the diving area is permitted only at the discretion of the lifeguards.
  • Diving from edges of the pool in the diving area is prohibited unless authorized by the lifeguards.
  • Flotation devices of any type are not permitted in the diving area. (Water wings are allowed in the main pool area ONLY).
  • Children who are non-swimmers and/or who are novice swimmers should not use the slide. If there is a question as to your child’s ability, you should check with the pool manager.
  • Only one person is permitted on the slide or stairs at any time. Do not climb the stairs until the slide platform is cleared.
  • Do not go down the slide until the previous slider has cleared the area.
  • Sliders must go down the slide feet first.
  • Slide may be closed at Pool Manager’s discretion.
  • Horseplay on the slide is prohibited.
VIII. RULES FOR CHILDREN
  • There will be a 10 minute break every hour, except for the first and last hour of operation, starting 45 minutes after the hour. These breaks, are reserved to lap swimming and/or water walking/jogging only. The wading pool is not affected by the break.
  • All children under 10 years of age shall be accompanied into the pool area by a responsible person who shall remain in the pool area. All inexperienced and novice swimmers shall have a responsible person who is attentive and within easy reaching distance of the swimmer at all times. A responsible person is considered as anyone 14 years or older.
  • Children ages 10 through 13, may come to the pool unaccompanied only after passing a swim test and a letter from their parents giving their permission is on file at the pool.
  • Children that are not toilet trained are required to wear swim diapers or snug plastic pants over cloth diapers. Bathing suits shall also be worn. DISPOSABLE AND CLOTH DIAPERS ARE PROHIBITED IN THE POOL. If this rule is not observed, closing of the pool for a complete filtration, requiring two hours or more, may be necessary. Please throw disposable diapers in the trash containers located in the rest rooms before entering the pool area. Do not use the containers outside for disposable diapers.
IX. BABY POOL
  • No lifeguards are stationed at baby pool.
  • Children 6 years or older may not use the baby pool.
  • DISPOSABLE DIAPERS ARE PROHIBITED. Rubber or plastic pants with tight fitting legs shall be worn over the cloth diapers and a bathing suit shall be worn.
  • All children using the baby pool shall be accompanied by a responsible person who shall remain within the baby pool enclosure. Children must not be left unaccompanied while in the baby pool enclosure.
  • When the pool is closed at no time should children be in the Baby Pool.
X. GENERAL RULES
  • ALL MEMBERS SHALL RESPECT THE PROPERTY RIGHTS OF HOMEOWNERS IN THE NEIGHBORHOOD. DO NOT USE OUR NEIGHBOR'S LAWNS FOR SHORTCUTS OR IN ANY WAY VIOLATE THE RIGHTS OF OTHERS.
  • No alcoholic beverages are permitted anywhere on the Poplar Tree Swim Club premises, including the parking area, except when approved by the Board of Directors in connection with adult social activities.
  • No persons under the influence of alcoholic beverages or drugs shall be permitted on the property.
  • Profanity, whether oral or by gesture, is prohibited in the pool area.
  • No persons shall use the pool unless it is officially open and lifeguards are on duty. Trespassers will be prosecuted.
  • All injuries which occur on the premises shall be reported to the Pool Manager immediately.
  • The cost of any property damage shall be charged to the member found responsible.
  • The club shall not be responsible for loss or damage to personal property. All lost articles turned over to the Pool Manager shall be held until the close of the swimming season. At that time, all unclaimed articles shall be disposed of appropriately.
  • The use of music players WITHOUT headphones shall be prohibited.
  • There shall be no "reserving" of deck chairs.
  • Basketball in the pool and volleyball in the grassy area shall be permitted at the discretion of the lifeguard.
  • All swimmers shall wear appropriate swim attire.
  • Breakable containers, glass baby bottles and glass food jars are prohibited in the pool area.
  • Running, pushing, wrestling, dunking, or causing undue disturbance in or around the pool is prohibited.
  • Gum, chewing tobacco, vaping and smoking are prohibited in the pool area.
  • All bicycle riders shall park their bicycles in the area designated for that purpose.
  • No skateboards or skates shall be used on the Poplar Tree Swim Club premises, particularly the parking lot.
  • Attachable flotation devices may be approved by the management for use by the handicapped at any time.
  • Ladders are used primarily for exiting the pool.
  • Lap lanes are for lap swimming only. In the event of multiple swimmers, "circle" swimming procedures will be followed. Entering or exiting from the lap lane side should be done without interfering with the lap swimmer(s).
  • Association members and their guests are required to leave the pool and pool house by closing time.
  • Only pool management staff is permitted in the guard station.
XI. PARKING AND SPEED LIMIT
  • The speed limit on the premises (driveway and parking area) is five (5) m.p.h. It is requested that members not park on the street if at all possible.
  • Vehicle maintenance is prohibited in the parking lot.
  • Overnight or commuter parking is prohibited in the parking lot.
  • Loitering on premises after pool hours is prohibited.
XII. INTERPRETATION OF RULES
  • The final interpretation of any rules shall be made and approved by the Board of Directors and/or their designated representatives; namely, the Pool Committee and the Pool Management Company.
